Legal and Operational Status

THEDERMALFILLER® operates as an independent EU commercial intermediary coordinating sourcing, pricing alignment and transaction execution within a structured B2B procurement framework.

The company:

– does not manufacture medical products;
– does not hold stock or warehouse goods;
– does not distribute, transport or physically deliver products;
– does not act as importer of record;
– does not provide medical advice or clinical guidance.

All products are supplied and dispatched by authorised EU manufacturers or licensed wholesalers, with THEDERMALFILLER® coordinating supplier allocation, commercial terms and transaction execution.

No public offer is made. No consumer transactions are conducted. Access is strictly limited to licensed healthcare professionals and authorised medical entities.

Order and Contract Formation
 

Orders are processed exclusively on a proforma-based prepayment system.

Submission of an order request or issuance of a proforma invoice does not constitute contract acceptance.

A binding contract is concluded only upon:
– explicit written order confirmation issued by THEDERMALFILLER®; and
– verified receipt of full advance payment.

THEDERMALFILLER® reserves the right to validate, structure, or decline any transaction prior to confirmation.

Automatic acknowledgements, preliminary communications, or payment transmission alone do not create contractual obligations.

All confirmed commercial terms (including price, quantity, scope and indicative timeframe) are defined exclusively in the written order confirmation.

Price Validity and Execution Window

The validity of quoted prices is strictly time-limited and subject to supplier confirmation.
Execution of the transaction must occur within the same business day following client confirmation in order to preserve quoted conditions.

Failure to proceed within this timeframe may result in price revision, supplier reallocation, or withdrawal of the offer.

Payment Terms
 

Payment is accepted exclusively via bank transfer (SEPA or international).

Payment confirmation triggers immediate supplier allocation and execution workflow initiation within the authorised EU supply chain.

No card payments, cash payments, cash-on-delivery, telephone payments, or consumer payment instruments are accepted.

Funds must:

– be received in full;
– match the exact proforma total;
– include the correct Proforma Reference.

All banking fees are borne by the sender.

Orders proceed to supplier allocation only after verified receipt of cleared funds.

Fulfilment Model
 

THEDERMALFILLER® does not perform physical delivery, warehousing or transport.
However, it coordinates fulfilment execution through authorised EU supply partners, ensuring alignment of commercial terms, documentation flow, and transaction integrity.

Products are released and dispatched exclusively by authorised EU pharmaceutical or medical distribution partners operating under documented regulatory compliance.

Responsibility for physical handling, storage conditions, cold-chain integrity, transport and release of goods rests with the authorised fulfilment partner.

Delivery Timeframe
 

Delivery timeframes are indicative and non-contractual.

Delivery timelines are dependent on supplier allocation, regulatory clearance and logistics availability.
THEDERMALFILLER® coordinates execution but does not guarantee fixed delivery dates.

Indicative timeframe: up to three (3) weeks from payment confirmation, subject to:

– supplier allocation schedules;
– regulatory clearance procedures;
– logistics capacity;
– cross-border compliance requirements.

Delays caused by factors beyond reasonable control do not constitute breach of contract.

Delivery Area
 

Orders are facilitated within selected European Union jurisdictions and associated regulatory territories.

Country availability is confirmed during order verification.

Customers are solely responsible for ensuring compliance with local import, licensing, and professional regulations in their jurisdiction.

Refund Policy
 

Refunds are granted exclusively where:

– procurement becomes objectively impossible prior to dispatch; or
– the authorised supplier fails to deliver within the confirmed delivery period.

In such cases:

Full advance payments are returned within fourteen (14) calendar days from written cancellation confirmation.

Refunds are issued to the originating bank account.

Bank processing times may extend the effective crediting period.

No withdrawal right applies in strictly professional B2B transactions.

No refunds apply once supplier allocation and execution have been initiated, except in cases of supplier non-performance as defined above.”

Returns
 

Returns are accepted exclusively in cases of:

– documented transport damage; or
– objectively incorrect product supplied.

Written notification must be submitted within fourteen (14) calendar days from delivery.

All return evaluations are subject to supplier verification.

Returns are not accepted for reasons related to client preference, ordering error, or change of intent in B2B transactions.

Limitation of Liability
 

THEDERMALFILLER® shall not be liable for indirect, incidental or consequential damages arising from supplier-level disruptions, regulatory delays or logistics constraints, except in cases of wilful misconduct or gross negligence.

Nothing in these terms excludes liability where such exclusion is prohibited by applicable law.

Commercial Positioning Clause

THEDERMALFILLER® acts as a commercial coordination layer within regulated EU supply chains.
Direct engagement with upstream suppliers outside this structured framework may result in loss of pricing conditions, allocation priority, and transaction support.
