By using this site, you (the “user” or “customer”) agree to be bound by these General Business Terms and Conditions, our Privacy Policy, and any other legal notices published on the site.

All content is presented in English. Translations into other languages are provided for convenience only and do not have legal value.

Please note:

TheDermalFiller® operates exclusively as an online intermediary. The company does not hold physical stock. Orders are fulfilled and shipped directly by our authorized EU-based logistics and distribution partners.

• You understand and accept that delivery is performed exclusively by third-party licensed suppliers, under our coordination.

All contracts shall be concluded exclusively in English, irrespective of the customer’s country of establishment or residence. Any general terms and conditions of the customer are hereby expressly excluded, even if not explicitly rejected in individual cases.

These Terms apply to, without limitation:

• All product sales and deliveries;
   
• All information, documentation, advice, and support provided via the platform;
   
• Any future, repeat, or follow-up transactions between the parties.
   

By placing an order, the customer unconditionally accepts these Terms, at the latest upon receipt of any products or services facilitated through the platform.

Any oral agreements, amendments, supplements, or deviations from these Terms shall be null and void unless expressly confirmed in writing by TheDermalFiller®. This written-form requirement may be waived only by an explicit written agreement signed by TheDermalFiller®.

TheDermalFiller® expressly rejects the legal validity of any alternative, additional, or conflicting terms submitted by the customer, including those incorporated into procurement systems, purchase orders, or standard confirmation processes.

The fulfilment of an order, delivery of products, or acceptance of payment shall not be construed as acceptance of any customer terms deviating from or supplementing these Terms.

3. Compliance with Applicable Laws and Regulations

TheDermalFiller® operates exclusively as an online platform governed by Romanian law and the mandatory legal framework applicable within the European Union. Access to and use of the website, as well as all transactions concluded via www.thedermalfiller.eu, are subject to Romanian law and directly applicable EU regulations.

TheDermalFiller® does not represent, warrant, or guarantee that any products offered on the platform are approved, permitted, or suitable for use in jurisdictions outside Romania or the European Union. It is the sole and exclusive responsibility of the customer to verify compliance with all applicable local, regional, national, medical, and professional regulations in the country where the products are ordered, delivered, imported, stored, or used.

By placing an order, the customer expressly confirms and warrants that they are legally authorized to purchase, possess, import, and use the relevant products under the laws and professional regulations applicable in their jurisdiction. Any importation, distribution, storage, or use of products is undertaken entirely at the customer’s own legal and professional risk.

TheDermalFiller® shall bear no liability whatsoever for any losses, damages, penalties, seizures by customs or regulatory authorities, legal disputes, administrative actions, or professional sanctions arising from the customer’s failure to comply with applicable laws, regulations, licensing requirements, or professional obligations in their jurisdiction.

4. Delivery Zone and Customer Address

TheDermalFiller® processes and forwards orders exclusively to customers whose billing and shipping addresses are located in the following countries:

Germany, Austria, Switzerland, France, United Kingdom, Spain, Italy, Denmark, Estonia, Finland, Luxembourg, Sweden, Bulgaria, Ireland, Latvia, Lithuania, Netherlands, Belgium, Norway, Poland, Portugal, Slovakia, Slovenia, Czech Republic, Hungary, Croatia, Greece.

Orders placed from outside the above-listed countries will not be accepted or processed.

Delivery Method and Responsibility

All deliveries are fulfilled exclusively by authorized third-party logistics and distribution partners, depending on the product and destination country. TheDermalFiller® does not operate its own warehouse, stock, or delivery fleet.

By placing an order, the customer expressly acknowledges and accepts that shipping, physical delivery, customs clearance, and final handover are performed entirely by the authorized supplier or distributor.

International Deliveries (Switzerland and Norway)

Deliveries to Switzerland and Norway may be subject to import duties, VAT, customs fees, or other regulatory charges. Such costs are not included in the prices displayed on the website and are entirely borne by the customer.

The customer is solely responsible for ensuring that all required permits, declarations, licenses, or certifications are obtained in a timely manner.

TheDermalFiller® shall bear no liability for delays, losses, refusals, or customs-related complications resulting from the customer’s failure to comply with applicable import, customs, or regulatory requirements.

5. Accuracy of Information

TheDermalFiller® makes every reasonable effort to ensure that all information presented on this website, including product descriptions, pricing, availability, delivery timelines, and any other commercial or informational content, is accurate and up to date. However, such information may occasionally contain typographical errors, inaccuracies, or omissions and may be subject to change at any time without prior notice.

Accordingly, TheDermalFiller® reserves the right, at its sole discretion, to:

6. Availability of Products

TheDermalFiller® provides information regarding medical aesthetic products that may not be available in all countries or regions. Product availability depends on destination country, product type, distributor stock levels, and applicable national and EU regulations. Products may also be marketed under different trademarks, formats, or labeling, depending on the country of fulfillment and regulatory authorization.

All products are supplied and delivered directly by licensed third-party distribution partners, based on customer location and product availability. TheDermalFiller® does not hold physical inventory, operate warehouses, or manage stock, and acts solely as a digital intermediary platform.

Customers are solely responsible for verifying import requirements, regulatory restrictions, and legal compliance in their respective jurisdictions. TheDermalFiller® assumes no liability for customs seizure, rejection, delay, or refusal resulting from national regulations or customer non-compliance.

If a product becomes unavailable or cannot be delivered for any reason after an order has been placed, the customer will be informed without undue delay and any amounts paid will be refunded in full.

7. Quotations and Contract Formation

All product offers, quotations, and information presented on the TheDermalFiller® website are non-binding and subject to change at any time without prior notice.

A legally binding contract is formed exclusively upon our explicit written order confirmation (including, but not limited to, confirmation by email, issued invoice, or other written confirmation), or upon the actual fulfillment and dispatch of the order by our authorized distribution partner, whichever occurs first.

Any amendments, supplements, modifications, or cancellations of a confirmed order must be made strictly in written form and shall be valid only upon our explicit written acceptance. Verbal agreements, informal communications, or implied understandings shall have no legal effect.

TheDermalFiller® retains full ownership, intellectual property rights, and copyright over all product images, technical documentation, specifications, price lists, calculations, quotations, and any related materials displayed on the website or transmitted through written or electronic communication. Such materials may not be reproduced, distributed, disclosed to third parties, or used for commercial purposes without our prior explicit written consent.

TheDermalFiller® operates exclusively as an online marketing and sales platform. All physical deliveries, logistics, and order fulfillment are performed solely by authorized third-party distribution partners. By placing an order, the customer expressly acknowledges and accepts that the execution of the delivery contract involves cooperation with such partners and that fulfillment is carried out by them under applicable regulatory frameworks.

8. Prices and Payment

All prices displayed on the TheDermalFiller® platform are stated in euros (EUR) and include VAT at the statutory rate applicable at the time of order, unless expressly stated otherwise. Logistics, shipping, handling, or packaging costs are not included in the listed prices and will be clearly disclosed to the customer prior to order confirmation or checkout.

Prices, applicable surcharges, and the total payable amount are presented to the customer before the order is finalized. Orders are invoiced at the prices valid at the moment the order is received and confirmed. Prices apply exclusively to the specific order placed and may change for future transactions. TheDermalFiller® reserves the right to modify prices at any time without prior notice.

TheDermalFiller® reserves the right to:

• limit purchase quantities per customer, per order, or per defined time period;
   
• refuse, suspend, or cancel orders in the event of pricing errors, technical issues, or product availability constraints;
   
• correct typographical, technical, or system-related errors in prices or product information, including after order placement, with appropriate notification to the customer.
   

Available payment methods are displayed during the checkout or order confirmation process and may include:

• bank wire transfer to our designated company account;
   
• other payment methods made available at our discretion.
   

TheDermalFiller® does not accept payment information via telephone, email, messaging applications, or social media channels and assumes no liability for payments attempted or processed through unofficial or unauthorized communication channels.

All invoices are issued exclusively by THEDERMALFILLER S.R.L., in accordance with applicable Romanian and EU fiscal and accounting regulations.

9. Place of Performance and Delivery Conditions

The place of performance for all contractual obligations shall be Romania, being the registered seat of THEDERMALFILLER S.R.L.

The risk of loss or damage to the products transfers to the customer at the moment the products are dispatched from the warehouse of the authorized logistics or distribution partner, irrespective of which party bears the transportation costs.

All shipments are covered by transport insurance. The cost of such insurance is borne by the customer, unless expressly stated otherwise in writing.

THEDERMALFILLER S.R.L. does not accept the return of transport or protective packaging. Customers are solely responsible for the environmentally compliant disposal of all packaging materials, at their own cost and in accordance with applicable local regulations.

IMPORTANT NOTICE ON DELIVERY

TheDermalFiller® does not perform direct delivery and does not maintain physical stock. All orders placed via our platform are shipped and fulfilled exclusively by authorized third-party logistics and distribution partners established within the European Union, under legally binding supply and fulfilment agreements.

By placing an order, the customer expressly acknowledges and accepts that:

• Delivery is executed entirely and solely by an authorized external distributor;
   
• TheDermalFiller® acts as the commercial platform, contractual seller, and invoice issuer, but does not physically store, handle, or dispatch goods;
   
• TheDermalFiller® cannot be held liable for transport delays, customs procedures, or damages occurring during shipment, except to the extent covered by the applicable transport insurance.
   

This fulfilment model is implemented to ensure efficient cross-border logistics, reliable stock allocation through licensed partners, and secure delivery processing across the European Union.

By placing an order, the customer fully accepts this delivery structure and all associated contractual and legal terms.

10. Minimum Order and Supply Interruption

TheDermalFiller® shall use commercially reasonable efforts to process and facilitate customer orders. However, TheDermalFiller® reserves the unrestricted right, at its sole discretion, to:

• Accept or reject any order without obligation to provide justification;
   
• Impose quantity limits per customer, transaction, or time period;
   
• Suspend, restrict, or discontinue the availability of any product at any time without prior notice.
   

In the event that a product becomes discontinued or temporarily unavailable, TheDermalFiller® may, without obligation, propose alternative products. TheDermalFiller® assumes no liability for any direct or indirect loss, delay, or damages arising from supply interruptions, stock shortages, logistical constraints, or order cancellations.

TheDermalFiller® does not maintain physical inventory. All products are supplied and shipped exclusively by licensed third-party distribution partners. If a distribution partner is unable to fulfil an order for any reason, including stock unavailability or delivery failure, TheDermalFiller® reserves the right to cancel the affected order and refund the full amount paid, without further liability or obligation.

Minimum Order Thresholds:

• Licensed healthcare professionals (direct purchase): No minimum order value applies.
   
• Authorized resellers or distributors: Minimum net order value of EUR 1,500 per transaction.
   

By placing an order, the customer expressly acknowledges and agrees to the conditions set out in this section.

11. Non-Compliance with General Business Terms and Conditions

In addition to any other rights or legal remedies available under applicable law or contract, TheDermalFiller® reserves the right, at its sole discretion, to:

• Refuse to accept, confirm, or process any order;
   
• Suspend, restrict, or terminate any ongoing transaction;
   
• Block access to the online platform and/or refuse any further sale of products,
   

in whole or in part, to any customer (and/or its affiliated entities) who:

• Fails to comply with these General Business Terms and Conditions;
   
• Attempts to circumvent contractual, regulatory, or payment obligations;
   
• Provides false, incomplete, inaccurate, or misleading information;
   
• Abuses the platform, ordering system, pricing structure, promotions, or product offerings in any manner.
   

Any such refusal, suspension, restriction, or termination may be implemented with or without prior notice and shall not give rise to any claim for damages, compensation, or indemnification against TheDermalFiller®.

By accessing or using the platform and by placing any order, the customer expressly acknowledges, accepts, and agrees to the enforcement of this section.

12. Delivery, Duty to Cooperate

The scope of TheDermalFiller®’s delivery obligations is strictly limited to and governed by these Terms and Conditions. All delivery timelines are conditional upon the customer’s full, timely, and accurate compliance with all contractual obligations, including but not limited to payment and provision of complete and correct information. TheDermalFiller® reserves the right to suspend or cancel delivery where the customer fails to provide the necessary cooperation.

If, despite timely and proper ordering, TheDermalFiller® is unable to source the ordered products from its reliable third-party suppliers, TheDermalFiller® shall be released from its obligation to perform and may cancel the customer’s order without liability. In such cases, the customer shall be informed without undue delay and any payments received shall be refunded in full.

Delivery shall be initiated only upon full receipt of payment. If payment is not received within twelve (12) working days from the payment request, TheDermalFiller® reserves the right to cancel the order unilaterally.

The estimated delivery time is approximately fourteen (14) working days from confirmed receipt of payment and shall not exceed thirty (30) working days under standard conditions. All delivery timelines are indicative and non-binding. Delays may occur due to circumstances beyond TheDermalFiller®’s control, including but not limited to supplier availability, customs procedures, transport disruptions, or force majeure events.

The customer expressly acknowledges and agrees that TheDermalFiller® does not perform the physical delivery of goods. All shipments are executed exclusively by licensed logistics and supply partners pursuant to a fulfillment agreement. This operational structure does not affect the contractual relationship between the customer and TheDermalFiller®.

The customer shall not be entitled to claim compensation for delivery delays, nor to request rescission of the contract, unless a delay exceeds sixty (60) working days from the date of payment, without prior notice or valid justification from TheDermalFiller® or its fulfillment partner.

13. Delays in Delivery and Third-Party Fulfillment Notice

All deliveries are performed exclusively through authorized third-party fulfilment partners, who are solely responsible for the preparation, packaging, and physical shipment of the products. TheDermalFiller® operates exclusively as an online contractual sales and intermediary platform and does not store, handle, or physically ship any goods.

If the agreed delivery date cannot be met due to circumstances beyond the control of TheDermalFiller®, its suppliers, or its logistics partners, including but not limited to upstream supplier delays, customs procedures, carrier disruptions, or similar events, the delivery period shall be reasonably extended. The customer shall be informed without undue delay of any such circumstances.

If the impediments persist for more than one (1) month after the expiry of the agreed delivery period, either party shall be entitled to rescind the contract without liability.

In the event of a proven delivery delay directly attributable to the logistics partner, and provided that the customer demonstrates a direct and verifiable financial loss caused exclusively by such delay, any compensation shall be strictly limited to a flat-rate amount of 0.5 percent of the net order value per full week of delay, capped at a maximum of 5 percent of the total net order value.

The customer may grant a final reasonable grace period for performance, which shall not be less than fifteen (15) working days. If delivery is not completed within this grace period, the customer may withdraw from the contract or claim the limited compensation specified above.

Important Notice:
All products are shipped exclusively by third-party logistics partners. TheDermalFiller® shall not be liable for delivery-related incidents or delays that fall outside its contractual and operational control. By placing an order, the customer expressly acknowledges and accepts this third-party fulfilment model.

14. Retention of Title

All delivered products shall remain the sole and exclusive property of TheDermalFiller® (THEDERMALFILLER S.R.L.) until full and irrevocable payment of the purchase price, including all associated costs such as shipping, taxes, and duties, has been received and definitively credited to our designated bank account.

Where payment is made by wire transfer or through any financial institution, ownership shall not pass to the customer until the full amount has been unconditionally received, is non-reversible, and has been finally credited to the account of TheDermalFiller®.

Until ownership is duly transferred, the customer shall hold the products in trust for TheDermalFiller®, shall not pledge, resell, encumber, or otherwise dispose of the products, and shall ensure that they are kept in their original condition and clearly identifiable as the property of TheDermalFiller®.

In the event of any breach of contract, including but not limited to default in payment, TheDermalFiller® reserves the right to reclaim possession of the products at the customer’s expense, without prejudice to any other rights or remedies available under applicable law.

15. Product Information

All information provided by TheDermalFiller® (THEDERMALFILLER S.R.L.) regarding its products is based on internal research, information obtained from reliable third-party sources, and professional experience in the field of medical and aesthetic products.

While every reasonable effort is made to ensure that such information is accurate, complete, and up to date, whether communicated orally, in writing, or published on the website, it does not constitute a legally binding representation, guarantee, or warranty, unless expressly confirmed in writing by TheDermalFiller® as part of a specific contractual agreement.

The customer is solely responsible for assessing the suitability of the products for their intended use, including but not limited to applications in aesthetic medicine. Any indication of intended use provided by the customer shall be binding upon TheDermalFiller® only if expressly and explicitly confirmed in writing prior to or at the time of contract conclusion.

This applies equally to matters relating to regulatory compliance, third-party intellectual property rights, and use within specific applications, procedures, or professional protocols. The customer bears full responsibility for verifying that the products comply with all applicable laws, regulations, and professional requirements in their jurisdiction and for ensuring lawful and appropriate use.

16. Return of Products

Returns are generally not accepted for products that have been opened, used, tampered with, or delivered more than 14 calendar days prior to the return request. Due to the nature of aesthetic medical devices, TheDermalFiller® accepts returns only under the strict conditions set out below.

A product may be returned exclusively if all of the following conditions are met:

• The product is unopened, unused, untampered with, and in its original, intact, and undamaged packaging;
   
• The return request is submitted within 14 calendar days from the date of delivery;
   
• The customer notifies TheDermalFiller® in writing of the intention to withdraw from the contract, by email to contact@thedermalfiller.eu;
   
• The product is returned to the designated return address at the customer’s own cost and risk;
   
• The returned shipment is properly packaged, secured, and fully traceable.
   

Returned products must be dispatched without undue delay and in any event no later than 14 calendar days from the date on which the customer notified TheDermalFiller® of the withdrawal. The return deadline is deemed met if the goods are shipped before the expiration of the 14-day period.

TheDermalFiller® reserves the right to refuse any refund in the following cases:

• Products returned in a damaged condition due to improper packaging, transport, or handling;
   
• Products showing any signs of opening, use, tampering, or partial consumption;
   
• Returns sent without prior written notification or without return authorization.
   

If a return is approved, refunds will be issued using the same payment method originally used, and only after the returned products have been received, inspected, and confirmed to fully comply with the above conditions. Shipping, handling, customs, and insurance costs are non-refundable.

Nothing in this section limits statutory rights where mandatory consumer protection law is applicable.

17. User Account

By registering on the TheDermalFiller® platform and creating a user account, you agree to provide accurate, complete, and up-to-date information at all times. You are solely responsible for maintaining the confidentiality and security of your login credentials (including username and password) and for all activities conducted through your account.

If you have any reason to believe that your account has been accessed, compromised, or used by an unauthorized third party, you must notify TheDermalFiller® immediately and in writing. TheDermalFiller® reserves the right to suspend or terminate any user account, without prior notice, in cases of suspected misuse, fraud, security breach, or violation of these General Business Terms and Conditions.

User accounts are personal and non-transferable. You are strictly prohibited from assigning, transferring, sharing, or otherwise granting access to your user account or login credentials to any third party, whether temporarily or permanently, without the prior explicit written consent of TheDermalFiller®.

TheDermalFiller® shall not be liable for any loss, damage, or unauthorized activity resulting from your failure to safeguard your account credentials or to comply with the obligations set out in this section.

18. Complaints Policy

TheDermalFiller® treats all complaints seriously and is committed to handling them promptly, objectively, and fairly. Receipt of any complaint submitted by email will be acknowledged within three (3) working days.

All complaints will be reviewed and investigated with due care. A written response will normally be provided within fourteen (14) calendar days from the date the complaint is received. If a full resolution cannot be achieved within this period, TheDermalFiller® will inform the customer of the reason for the delay and provide an estimated timeframe for final resolution.

All complaints must be submitted exclusively in writing by email to contact@thedermalfiller.eu. Complaints made verbally or through any other channel shall not be considered valid or binding unless subsequently confirmed in writing.

Complaints must include sufficient details to allow proper assessment, including but not limited to: customer identification, order reference, a clear description of the issue, and any relevant supporting documentation. Failure to provide adequate information may delay or prevent the resolution process.

This Complaints Policy does not affect or limit any statutory rights available to customers under applicable law.

19. Place of Jurisdiction

These General Business Terms and Conditions, as well as any disputes arising out of or in connection with them, including their formation, validity, interpretation, performance, or termination, shall be governed exclusively by the laws of Romania, without regard to its conflict of laws rules.

The exclusive place of jurisdiction for all legal disputes arising directly or indirectly from the contractual relationship shall be the competent courts of Romania.

Notwithstanding the foregoing, TheDermalFiller® reserves the right, at its sole discretion, to initiate legal proceedings against the customer before the courts having jurisdiction at the customer’s registered seat, domicile, or principal place of business, as applicable.

20. Applicable Law and Dispute Resolution

These General Business Terms and Conditions, as well as any agreements concluded pursuant to them, shall be governed exclusively by the substantive laws of Romania, expressly excluding the application of the United Nations Convention on Contracts for the International Sale of Goods (CISG).

In the absence of an amicable settlement, any dispute, controversy, or claim arising out of or in connection with these Terms, including their existence, validity, interpretation, performance, or termination, shall fall under the exclusive jurisdiction of the competent courts of Romania.

TheDermalFiller® makes no representation that the materials, products, or information available on this website are appropriate or available in all jurisdictions. Access to this website from territories where its content or use is unlawful is prohibited. Users accessing the website from outside Romania do so on their own initiative and are solely responsible for compliance with all applicable local laws and regulations.
