This website is operated by THEDERMALFILLER S.R.L., a company registered in Romania, hereinafter referred to as "TheDermalFiller®", “we”, “us”, or “our”. The contractual partner in all transactions concluded through this site is THEDERMALFILLER S.R.L.

By using this site, you (the “user” or “customer”) agree to be bound by these General Business Terms and Conditions, our Privacy Policy, and any other legal notices published on the site.

All content is presented in English. Translations into other languages are provided for convenience only and do not have legal value.

Please note:

TheDermalFiller® operates exclusively as an online intermediary. The company does not hold physical stock. Orders are fulfilled and shipped directly by our authorized EU-based logistics and distribution partners.

By accessing or using our website, you agree that:

• You understand and accept that delivery is performed exclusively by third-party licensed suppliers, under our coordination.
   
• You are responsible for verifying product suitability and compliance with your local laws before ordering.
   
• You use this site at your own risk.
   

We reserve the right to update, modify, suspend, or discontinue any part of the site at any time, without prior notice. Changes to our Terms and Conditions will take effect immediately upon being posted. It is your responsibility to regularly check this page for updates.

These General Business Terms and Conditions constitute the exclusive legal framework for all contracts concluded via the online platform of THEDERMALFILLER S.R.L., headquartered at Basel 4, 300127 Timișoara, Romania (hereinafter referred to as "TheDermalFiller®"), with customers worldwide.

All contracts shall be concluded exclusively in English, regardless of the customer’s country of origin. Any general terms and conditions of the customer are hereby expressly excluded, even if not explicitly rejected in each case.

These Terms apply to:

• All product sales and deliveries;
   
• All related information, advice, and support provided via our platform;
   
• Any future or follow-up transactions.
   

By placing an order, the customer unconditionally accepts these Terms, at the latest upon receiving any products or services facilitated through our site.

Any oral agreements, modifications, additions or deviations from these Terms shall be null and void unless expressly confirmed in writing by TheDermalFiller®. This written form requirement may only be waived through written agreement.

We explicitly reject the legal validity of any alternative or conflicting terms submitted by the customer, even if communicated through standard confirmation processes or integrated into procurement systems.

Fulfilling an order, delivering a product, or accepting a payment shall not be interpreted as acceptance of any conflicting customer terms.

TheDermalFiller® operates exclusively as an online platform accessible from within the European Union (EU). Access and use of our website, as well as all orders placed via www.thedermalfiller.eu, are governed by Romanian law and the regulations applicable within the EU.

TheDermalFiller® does not guarantee that the products offered are approved or suitable for use in any specific jurisdiction outside of Romania or the EU. It is the sole responsibility of the customer to verify compliance with all applicable local, regional, or national laws and medical regulations in the country where the product is ordered, delivered, or used.

By placing an order, the customer expressly confirms that they are authorized to purchase and use such products under the applicable laws of their country and that any import, usage or application is done at their own legal and professional risk.

TheDermalFiller® accepts no liability for any damages, penalties, customs seizures, legal disputes, or professional sanctions resulting from the customer's failure to comply with local laws or professional restrictions in their jurisdiction.

TheDermalFiller® processes and forwards orders exclusively to customers whose billing and shipping addresses are located in one of the following countries:

Germany, Austria, Switzerland, France, United Kingdom, Spain, Italy, Denmark, Estonia, Finland, Luxembourg, Sweden, Bulgaria, Ireland, Latvia, Lithuania, Netherlands, Belgium, Norway, Poland, Portugal, Slovakia, Slovenia, Czech Republic, Hungary, Croatia, Greece.

Orders placed from outside these countries will not be accepted or processed.

Important Notice:
Deliveries are fulfilled exclusively by our third-party logistics and distribution partners, depending on the product and destination country. TheDermalFiller® does not operate its own warehouse or delivery fleet. By placing an order, you acknowledge and accept that the shipping, physical delivery, and customs clearance are fully performed by the authorized partner/distributor.

International Deliveries (Switzerland, Norway):
Deliveries to Switzerland or Norway may be subject to import duties, VAT, or other customs-related charges. These costs are entirely borne by the customer and are not included in the prices displayed on our website. It is the customer’s exclusive responsibility to ensure that any necessary permits, declarations, or certifications are obtained in a timely manner.

TheDermalFiller® shall not be held liable for any delays, losses, or customs-related complications resulting from the customer’s failure to comply with the applicable import regulations in their country.

TheDermalFiller® makes every reasonable effort to ensure that all information presented on this website — including product descriptions, pricing, availability, delivery timelines, and any other commercial or promotional content — is accurate and current. However, such information may occasionally contain typographical errors, inaccuracies, or omissions, and may be subject to change at any time without prior notice.

We therefore reserve the right, at our sole discretion:

• to correct any errors or inaccuracies;
   
• to update or modify content and pricing;
   
• to withdraw, substitute, or suspend products or services without prior notice;
   
• to cancel or refuse any orders placed based on incorrect, outdated, or incomplete information, even after such orders have been confirmed.
   

If any changes affect an order already placed, the customer will be notified without delay.

All product visuals, descriptions, and specifications are provided for informational and illustrative purposes only. Final packaging, formulation, instructions for use, or country of origin may vary depending on the licensed distribution partner fulfilling the delivery.

TheDermalFiller® does not guarantee real-time availability and is not liable for any reliance placed on inaccurate or outdated product information, whether originating from us or from third-party suppliers.

TheDermalFiller® provides information about medical aesthetic products that may or may not be available in every country or region of the European Union. Availability may vary by destination, product type, distributor stock levels, and national regulations. Products may also be marketed under different trademarks, formats, or labeling, depending on the country of fulfillment and regulatory approval.

We do not guarantee that a listed product will be available at the time of purchase or that it is approved for use in your specific country.

All products are delivered directly by our licensed distribution partners, depending on customer location and product availability. TheDermalFiller® does not maintain physical stock or warehouse facilities and acts solely as a digital sales platform.

Customers are solely responsible for verifying local import rules, restrictions, and legal compliance in their respective jurisdictions. TheDermalFiller® assumes no liability for customs seizure, rejection, delay, or refusal based on national regulations.

If a product becomes unavailable or cannot be delivered for any reason, the customer will be informed as soon as possible and refunded in full.

All product offers presented on TheDermalFiller® website are non-binding and subject to change without notice. A legally binding contract is only formed upon our explicit written order confirmation (email, invoice, or other written form), or upon the actual fulfillment of the order by our distribution partner, whichever occurs first.

Amendments, supplements, or cancellations of a confirmed order must be made in writing and are valid only upon our formal written agreement. Verbal agreements or informal correspondence shall not be deemed valid.

We retain full ownership and copyright over all product images, technical drawings, price lists, calculations, and any related documents displayed on this website or provided through communication. These materials may not be reproduced, shared with third parties, or used for commercial purposes without our explicit prior written consent.

TheDermalFiller® acts exclusively as an online marketing and sales platform, and all physical deliveries are performed by authorized third-party distribution partners. The formation and execution of the delivery contract includes cooperation with such partners, and the customer accepts this by placing the order.

All prices on TheDermalFiller® platform are listed in euros (€) and include VAT at the statutory rate applicable at the time of order, unless otherwise stated. Logistics and shipping costs are not included in the listed price and will be clearly shown before checkout.

Prices, applicable surcharges (such as packaging, shipping, or handling), and total payable amounts will be clearly displayed to the customer before the order is finalized. Orders are invoiced at the prices valid at the moment we receive the order. These prices apply exclusively to that particular order and may differ in future. We reserve the right to change prices at any time without prior notice.

TheDermalFiller® reserves the right to:

• Limit purchase quantities per customer, per order, or per time period;
   
• Refuse or cancel orders in case of pricing errors or availability issues;
   
• Correct typographical or system errors in prices or product details even after order placement, with prior notice to the customer.
   

Available payment methods will be displayed to the customer during the checkout process and may include:

• Wire transfer to our designated bank account;
   
• Credit or debit card payment via the secure checkout system;
   
• Other methods may be made available at our discretion.
   

TheDermalFiller® does not accept payment information via phone, email, or social media, and disclaims all liability for attempts to process payments through unofficial channels.

All invoices are issued by THEDERMALFILLER S.R.L.. For legal and operational transparency, the customer acknowledges and agrees that products are delivered directly by our authorized distribution partners, while billing and commercial communication are handled exclusively by TheDermalFiller®.

The place of performance for all contractual obligations shall be Romania, the registered seat of THEDERMALFILLER S.R.L.

Risk transfers to the customer at the moment the products are dispatched from our logistics partner’s warehouse, regardless of who bears the transportation costs. All shipments are covered by transport insurance, and the customer shall bear the cost of such insurance. We do not accept return of transport packaging. Customers are solely responsible for the environmentally compliant disposal of packaging materials at their own expense.

TheDermalFiller® does not carry out direct delivery or maintain physical stock.
All orders placed via our platform are shipped and fulfilled exclusively by our contracted logistics partners, based in the EU, under a legally binding fulfillment and supply agreement.

By placing an order, the customer expressly acknowledges and accepts that:

• Delivery is executed entirely and solely by an authorized external distributor;
   
• TheDermalFiller® acts as commercial platform, contractual seller, and invoice issuer, but does not physically handle or dispatch goods;
   
• TheDermalFiller® cannot be held liable for transport delays, customs handling, or damages occurring during shipping, beyond what is covered by the included transport insurance.
   

This fulfillment model is designed to ensure:

• Efficient cross-border shipping;
   
• Accurate real-time stock availability;
   
• Faster and more secure delivery processing across the EU.
   

By placing an order, the customer fully accepts this delivery structure and all associated legal terms.

TheDermalFiller® shall make commercially reasonable efforts to process and fulfill all customer orders. However, we reserve the full right, at our sole discretion, to:

• Accept or reject any order without providing justification;
   
• Limit quantities per transaction or customer;
   
• Suspend or discontinue the availability of any product at any time and without prior notice.
   

In the event a product is discontinued or temporarily unavailable, TheDermalFiller® may, without obligation, suggest available alternatives. TheDermalFiller® assumes no liability for any direct or indirect loss resulting from supply interruptions, delays, or cancellation of any order.

Please note: TheDermalFiller® does not hold physical inventory.
All products are supplied and shipped by external distribution partners.
If our partner is unable to fulfill a product order (e.g., due to stock shortage or failure to deliver), we reserve the right to cancel the corresponding customer order and refund the full amount received, without further obligations or liability.

• Licensed medical practitioners (direct purchase): No minimum order value required.
   
• Authorized resellers or distributors: Minimum net order value of €1,500 per transaction.
   

By placing an order, the customer explicitly agrees to the terms outlined above.

In addition to any other rights or legal remedies available under applicable law or contract, TheDermalFiller® reserves the right to:

• Refuse to accept or process any order;
   
• Suspend or terminate any ongoing transaction;
   
• Block access to the online store and/or refuse any further sale of products,
   

in whole or in part, to any customer (and/or its affiliated entities) who:

• Fails to comply with these General Business Terms and Conditions;
   
• Attempts to circumvent contractual obligations;
   
• Provides false, incomplete, or misleading information;
   
• Abuses our systems, pricing structure, or product offering in any way.
   

Such refusal or suspension may occur with or without prior notice, at the sole discretion of TheDermalFiller®, and shall not give rise to any claim for damages or compensation from the customer.

By using this platform and placing orders, the customer explicitly acknowledges and agrees to these conditions.

The scope of our delivery obligation is exclusively defined by this contract. All delivery timelines are subject to the customer's timely and full compliance with their contractual obligations. We reserve the right to suspend or cancel delivery if the customer fails to provide necessary cooperation, including but not limited to timely payment and accurate information.

If we are unable to obtain the ordered products from our reliable third-party suppliers despite placing timely and proper orders, we shall be released from our obligation to perform and may cancel the customer's order without liability. In such cases, we will inform the customer immediately and refund any payments made.

Deliveries will only be initiated upon full receipt of payment. If payment is not received within twelve (12) working days of the payment request, TheDermalFiller® reserves the right to cancel the order unilaterally.

Estimated delivery time is approximately fourteen (14) working days after the confirmed receipt of payment, but shall not exceed thirty (30) working days under standard conditions. These timelines are indicative and non-binding; delays may occur due to factors beyond our control, including supplier stock status, customs, transport, or force majeure events.

Customers acknowledge and expressly agree that TheDermalFiller® does not perform the physical delivery of any goods. All shipments are carried out exclusively by our licensed logistics and supply partners, based on a fulfillment agreement. This structure ensures streamlined operations and optimal logistics, without altering the contractual nature of the sale between the customer and TheDermalFiller®.

Customers shall not be entitled to claim compensation for any delay in delivery, nor to demand rescission of the contract, unless a delay exceeds sixty (60) working days from payment, without prior notice or valid justification from TheDermalFiller® or its fulfillment partner.

Deliveries are carried out exclusively via our authorized fulfillment partner(s), who are responsible for the preparation, packaging, and physical shipment of the products. TheDermalFiller® acts solely as an online intermediary and contractual sales platform, without storing, handling, or directly shipping any goods.

If we are unable to keep the agreed delivery date due to circumstances which are not within our or our supplier’s or logistics partner’s control (e.g., delays from upstream suppliers, customs clearance, carrier delays, etc.), the delivery period shall be reasonably extended. We will immediately inform the customer of any such situation.

Should the impeding circumstances still exist one month after the agreed delivery period has expired, each party has the right to rescind the contract without liability.

In case of a proven delay in delivery attributable to our logistics partner and if the customer furnishes evidence of a financial loss caused directly by such delay, compensation shall be limited to a flat-rate amount of 0.5% of the net order value per full week of delay, not exceeding 5% of the total net order value. The customer may set a final reasonable grace period for performance, which may not be less than 15 working days. If this period expires without delivery, the customer may withdraw from the contract or demand limited damages in accordance with the above.

Important Notice:
All products are shipped exclusively by third-party logistics partners, and TheDermalFiller® shall not be held liable for delivery-related incidents outside of its contractual and operational control. By placing an order, the customer explicitly agrees to this third-party fulfillment model.

All delivered products shall remain the sole and exclusive property of TheDermalFiller® (THEDERMALFILLER S.R.L.) until full payment of the purchase price, including all associated costs (such as shipping and taxes), has been received and irrevocably credited to our designated bank account.

If the payment is made via wire transfer or through a financial institution, ownership shall not transfer to the customer until the full amount is unconditionally received and non-reversible, and has been definitively credited to the account of TheDermalFiller®.

Until such time as ownership transfers, the customer shall hold the products in trust for TheDermalFiller®, shall not pledge, sell, or otherwise dispose of them, and shall keep them in their original condition. In case of breach of contract, including default in payment, we reserve the right to reclaim possession of the products at the customer's expense.

All information provided by TheDermalFiller® (THEDERMALFILLER S.R.L.) regarding its products is based on thorough internal research, reliable external sources, and practical experience in the field of medical devices.

While we make every effort to ensure the accuracy, completeness, and timeliness of such information—whether provided orally, in writing, or published on our website—this information does not constitute a legally binding representation or warranty, except where explicitly confirmed in writing in the context of an individual contractual agreement.

Customers are solely responsible for determining the suitability of our products for their intended application, including but not limited to use in aesthetic medicine. Any description of the intended use provided by the customer shall only be binding upon TheDermalFiller® if we have explicitly confirmed in writing, prior to or at the time of contract conclusion, that the product is fit for the specified purpose.

This also applies to matters involving third-party industrial property rights, regulatory requirements, or use in specific applications, procedures, or protocols. The customer bears full responsibility for verifying regulatory compliance and appropriateness of use in their jurisdiction. 

Returns are generally not accepted for products that have been opened, used, or delivered more than 14 calendar days prior to the return request. TheDermalFiller® does not accept returns for aesthetic medical devices unless the return conditions below are strictly met.

You may return a product only under the following conditions:

• The product is unopened, unused, and in original, undamaged packaging;
   
• The return request is submitted within 14 calendar days from the date of delivery;
   
• You notify TheDermalFiller® in writing (via email to contact@thedermalfiller.eu) of your decision to withdraw from the contract;
   
• The products are shipped back to our designated return address at your own expense and risk;
   
• You ensure the package is appropriately secured and traceable.
   

You must return or deliver the products without undue delay and in any event no later than 14 calendar days from the date you notified us of your intent to withdraw. The return period is considered respected if the goods are shipped before the 14-day deadline expires.

We reserve the right to refuse refunds for:

• Products returned in a damaged condition due to improper packaging or handling;
   
• Products showing signs of tampering or partial use;
   
• Packages returned without prior written notification or authorization.
   

Refunds, if approved, will be issued via the same payment method originally used, and only after we have received and inspected the returned products.

By registering on the TheDermalFiller® platform and creating a user account, you agree to provide accurate, complete, and current information. You are solely responsible for maintaining the confidentiality of your login credentials (username and password), and for all activities that occur under your account.

If you have any reason to believe that your account has been accessed or used by an unauthorized third party, you must notify TheDermalFiller® immediately and in writing. We reserve the right to suspend or terminate any account in case of suspected misuse, fraud, or violation of these General Business Terms and Conditions.

You are strictly prohibited from transferring your user account or login credentials to another person or entity without prior written approval from TheDermalFiller®.

TheDermalFiller® takes all complaints seriously and is committed to resolving them promptly and fairly. We will acknowledge receipt of any complaint sent by email within three (3) working days.

All complaints will be thoroughly investigated. A written response will normally be provided within fourteen (14) calendar days from the date of receipt of the complaint. If a full resolution cannot be provided within this time frame, we will inform the customer of the cause of the delay and provide an estimated timeframe for resolution.

All complaints must be submitted in writing via email to: contact@thedermalfiller.eu. Verbal complaints will not be considered formal unless confirmed in writing.

These General Business Terms and Conditions and any disputes arising out of or in connection with them, including their conclusion, validity, interpretation, execution or termination, shall be governed exclusively by the laws of Romania, without regard to its conflict of laws principles.

The exclusive place of jurisdiction for all legal disputes arising directly or indirectly from the contractual relationship shall be the competent courts of Romania. However, TheDermalFiller® shall also be entitled to bring an action at the customer’s general place of jurisdiction.

These General Business Terms and Conditions and any agreements entered into under them shall be governed exclusively by the substantive laws of Romania, excluding the application of the United Nations Convention on Contracts for the International Sale of Goods (CISG).

In the absence of an amicable settlement, any dispute, controversy, or claim arising out of or in connection with these terms – including their existence, validity, interpretation, performance, or termination – shall be subject to the exclusive jurisdiction of the competent courts of Romania.

TheDermalFiller® makes no representation that the materials, products, or information available on this site are appropriate or available in all languages or jurisdictions. Access to the website from territories where its content is unlawful is prohibited. Users accessing the site do so at their own initiative and are responsible for compliance with local laws.
